ARTICLE 1: AREA OF APPLICATION
These general terms of sale apply to all sales conducted via the www.audio-archives.com and www.audio-archives.fr websites and to all telephone and mail order sales between the AUDIO-ARCHIVES division of CENTRALWEB and the person placing the order ("the customer").
These conditions govern specifically the sale of cassette tapes and CDs presented on the site.
Any condition contrary to the present terms posed by the customer, unless specifically agreed in writing, will not therefore be applicable to AUDIO-ARCHIVES at whatever time it is communicated. AUDIO-ARCHIVES reserves the right to modify the present general terms of sale at any time on condition that the changes are displayed on its site.
ARTICLE 2: ORDERS
AUDIO-ARCHIVES undertakes to accept any order placed within the conditions of the present general terms of sale. By confirming your order, you agree to abide by the general terms of sale as presented on this site. Orders may be place as follows:
NB. For credit card payments by fax and mail order, you must provide the security number on the back of the card as well as the credit card number and expiry date.
ARTICLE 3: PRODUCT AVAILABILITY
Reasonable quantities of all items for sale on the site are usually available in the distribution centre. If, following a large and unexpected order, any item should be unavailable the customer may decide to cancel the order or to wait for the product to become available again. In this case, the customer will be personally informed of the new availability date of the missing product.
ARTICLE 4: NET PRICE
Prices are given net in euros including shipping. They can be changed at any time without warning on the understanding the prices charged will be those listed at the time the order is placed. All orders will be invoiced in euros and payment will be in euros. Prices will be payable in full, in one instalment when ordering. VAT is charged on all products sold at the applicable rate when the order is placed. Import duty and/or other local taxes, where applicable, will be paid by the customer under the customer's responsibility.
ARTICLE 5: FREE SHIPPING
Shipping costs are included in the listed price for all countries.
ARTICLE 6: ORDER CONFIRMATION
When clicking on the CONFIRM button after placing an order, the customer agrees to abide by the order and all the present general terms of sale without reserve. Data recorded in the payment system is proof of the financial transaction.

ARTICLE 8: TOTAL SATISFACTION GUARANTEE
All our products are guaranteed new and unused direct from the publishers. AUDIO-ARCHIVES offers a full "total satisfaction" guarantee. If an item does not meet expectations, customers should inform us by mail or by email at: info@audio-archives.com. We will find a solution if there is either the handling error or a technical problem with the disk. Depending on the circumstances, we will ship a replacement product free for the faulty or missing item or you will have 7 working days to return the product concerned in its original packaging.
ARTICLE 9: SHIPPING AND LEAD TIMES
If your order is placed in France or abroad, it will be shipped to the address given during the order, unless otherwise stated. Shipping time includes handling and packing the order and transport. The average time for an order to be delivered in France and the European Union is 4 days, and 8 days overseas. However, AUDIO-ARCHIVES has no control over postal services and cannot be held accountable for delays caused by the French or any foreign Post Office. If you pay for your order by cheque or money order, it will not be processed until payment is cleared and the shipping time will be longer accordingly.
ARTICLE 10: REFUNDS
Because of the secure payment system used, we have no record of your credit card details. Refunds will therefore be made by cheque for customers in France and by money order for overseas residents.
ARTICLE 11: RETURNED PRODUCTS
Products must be returned in their original packaging. Please include the shipping form received with the product to obtain your refund. We will refund the product under the conditions of article 7 not including return shipping costs. Products should be returned to:

ARTICLE 12: LIABILITY
Titles listed in the AUDIO-ARCHIVES database have been entered based on information from the publishers. AUDIO-ARCHIVES is not responsible for the content of these works and cannot be held accountable by its customers. The customer knows and accepts the risks incurred on the internet and computer networks and specifically recognises that personal information could be misused, particularly in countries which do not offer adequate levels of protection of personal information.
ARTICLE 13: PROTECTION OF PERSONAL INFORMATION
AUDIO-ARCHIVES handles all personal information about its customer in the strictest confidence. While placing an order, you are only required to enter information that is necessary for the billing and shipping processes (name, first name, address, telephone, email).
AUDIO-ARCHIVES maintains a database with information about all its users and undertakes to implement appropriate technical systems to protect all information of a personal nature. The customer expressly agrees to the existence of this database. The information is for use by AUDIO-ARCHIVES and will not be communicated to third parties.
Personal information entered into the www.audio-archives.com site is covered by the French law on "Data Protection and personal information" No. 78-17 from 6 January 1978, in compliance with AUDIO-ARCHIVES statement to the CNIL (National Committee for Date Protection and Personal Information).
This means that customers who have entered personal information into this site under their name can ask the service administrator to see the information and modify it if necessary.

All clauses in the present general terms of sale are governed by French law and legal claims will be heard by the Nanterre Court where CENTRALWEB's head office is located and where the contract is drafted..
